Non-compete, Non-solicitation and Non-disclosure Agreements 

I am often asked about the enforceability of non-compete, non-solicitation and non-disclosure Agreements.  The answer depends on the specific facts of your case.  These agreements can be  enforceable if certain legal requirements are met.                                     
A non-compete agreement prohibits a former employee from working with a competitor within the same geographic area in which the employer operates for a specified period of time. 

A non-solicitation agreement prohibits a former employee from contacting clients and often other employees for the purpose of luring them away from the former employer. 

A non-disclosure agreement prohibits a former employee from disclosing confidential, proprietary or trade secret information.  

Often, you will find all three of these agreements combined into one document.

Employment contracts 
                
Since Kentucky is an employment at will state, it is rare for an employer to deliberately create a contract of employment.  However, there are still a number of contracts that an employee may be asked to sign. This includes non-compete agreements, non-solicitation agreements, non-disclosure agreements and severance agreements.
